1. Service Description
Fmlyr ("we," "us," or "our") provides identity verification services to subscription content creators ("creators") and their fans ("users"). By using our service, you agree to these Terms.
Fmlyr is a standalone identity verification tool. Creators may send a verification link to users via third-party platforms (e.g., OnlyFans, Instagram, Patreon). Users who click the link will:
- Submit their face image and government-issued ID for verification.
- Have their identity information securely stored and encrypted in our databases.
- Associate their chosen username with their verified status.
The app does not facilitate communication, interactions, or content sharing. It is strictly a verification checkpoint.
2. Prohibited Use of the App
You agree not to:
- Submit fraudulent, falsified, or stolen identity documents.
- Circumvent the verification process (e.g., using AI-generated images, proxies, or VPNs to mask your identity).
- Use the app for any unlawful purpose, including:
- Harassment: Repeatedly contacting a creator after being asked to stop; creating multiple accounts to bypass blocks; impersonating a creator or user; threatening to expose private information (e.g., "I'll leak your address").
- Cyberstalking: Behavior meeting the legal definition under 18 U.S. Code § 2261A, including intentional conduct causing substantial emotional distress or fear of harm.
- Doxxing: Sharing private identity information (e.g., real name, address) without consent.
3. Data Storage and Security
- What We Store: Face image, government ID, verification timestamp, and creator/user account linkage.
- How We Protect It: Data is encrypted at rest and in transit. We use industry-standard security protocols.
- Data Retention: Identity information is retained for 5 years unless deleted earlier by the creator, fan, or due to legal requirements. Fans deleting verification data are informed that they lose their verification status upon doing so.
4. Disclosure of Identity Information
Identity information will not be shared with creators under normal circumstances. However, we may disclose data to law enforcement or authorities in the following situations:
A. Criminal Threats or Harm
If a creator reports a credible criminal threat (e.g., threats of violence, blackmail, or extortion) occurring on a third-party platform, and provides verifiable evidence (e.g., screenshots, police reports), we will:
- Review the evidence to confirm its validity.
- Disclose the relevant user's identity information only to law enforcement after receiving a valid legal request (e.g., subpoena, court order).
B. Cyberstalking
If a creator reports cyberstalking (as defined by 18 U.S. Code § 2261A) occurring on a third-party platform, we will:
- Require the creator to submit detailed evidence (e.g., repeated threatening messages, doxxing attempts, or evidence of substantial emotional distress).
- Conduct a rigorous review to confirm the behavior meets the federal legal standard.
- Disclose identity information only to law enforcement after receiving a valid legal request.
No disclosure will occur for minor disagreements, isolated incidents, or unverified claims.
5. User Rights and Transparency
- Notifications: If your identity information is disclosed due to a report, we will notify you unless prohibited by law (e.g., an active police investigation).
- Appeals: You may appeal our decision to disclose your information by contacting Legal@Fmlyr.com within 30 days of notification.
- Appeals review whether:
- The legal threshold for disclosure was met (e.g., valid subpoena or credible federal violation).
- Our internal review process was followed correctly.
- Note: Disclosures to law enforcement are irreversible, but successful appeals will result in corrective measures for future decisions.
- Data Deletion: Users may request deletion of their data unless retained for legal reasons (e.g., ongoing investigations).
6. Creator Responsibilities
Creators agree to:
- Use the app only for lawful verification purposes.
- Not misuse reports (e.g., filing false or retaliatory claims against users).
- Never disclose, publish, or share user identity information obtained through Fmlyr. Violations will result in immediate account termination and legal action.
- Cooperate with Investigations: Provide accurate evidence (e.g., timestamps, unedited screenshots) when reporting harassment.
- Acknowledge that Fmlyr does not monitor third-platform behavior and is not liable for interactions occurring outside the app.
7. Creator Support & Safety Tools
- Emergency Takedowns: If a creator provides credible evidence of imminent harm, we will temporarily suspend the accused user's verification status pending investigation.
- Evidence Assistance: Creators may request help from Fmlyr to compile timestamps, metadata, or other documentation for law enforcement.
- Shared Blocklist: Creators can opt into a network-wide blocklist to preemptively ban users flagged for harassment on other platforms.
8. Penalties for Violations
Violations may result in:
- Permanent Ban: Immediate termination of your account and lifetime prohibition from re-verifying.
- Cross-Platform Reporting: Flagged users may be reported to partnered platforms (e.g., OnlyFans, Instagram) for further action.
- Legal Action: Civil liability for intentional infliction of emotional distress, with Fmlyr providing evidentiary support to creators.
9. Limitation of Liability
Fmlyr is not responsible for:
- User behavior on third-party platforms.
- Creator misuse of the verification system or false reports.
- Technical errors in verification, though we will rectify them promptly.
10. Legal Compliance
- We comply with all applicable privacy laws (e.g., GDPR, CCPA, PIPL).
- Identity disclosures will occur only in response to valid legal requests (e.g., subpoenas, court orders) or emergencies (e.g., imminent threats to life).
- Prohibited Public Disclosure: Creators are forbidden from sharing user identity information publicly. Violations will be reported to authorities under anti-doxxing laws.
